In this Agreement the following terms shall have the following meanings:
1.1 "Account": means collectively the personal information, Payment Information and credentials used by Users to access Paid Content and/or any communications System on the Website.
1.2 "Content": means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Website.
1.3 "Facilities": means collectively any online facilities, tools, services or information that NZ Drones Academy makes available through the Website either now or in the future.
1.4 "Services": means both (a) online training delivered through the NZ Drones Academy e-learning platform, and (b) in-person training courses delivered at Our premises, client locations, or other training venues.
1.5 "Payment Information": means any details required for the purchase of Services from this Website, including credit/debit card numbers and billing addresses.
1.6 "Premises": means our registered place of business.
1.7 "System": means any online communications infrastructure that NZ Drones Academy makes available through the Website either now or in the future.
1.8 "User"/"Users": means any third party that accesses the Website and is not employed by NZ Drones Academy and acting in the course of their employment.
1.9 "Website": means the website that you are currently using (nzdronesacademy.co.nz) and any sub-domains of this site.
1.10 "We/Us/Our": means NZ Drones Academy Ltd, a company registered in New Zealand under the Companies Act 1993.
2.1 Persons under the age of 18 may only use this Website or attend in-person courses with the supervision of a parent or guardian.
2.2 Payment Information must be provided by or with the permission of an adult.
These Terms and Conditions also apply to customers procuring Services in the course of business.

7.2 Deep linking (to specific pages) requires Our express written permission.
8.1 When using any System on the Website you agree:
8.1.1 Not to use obscene or offensive language;
8.1.2 Not to submit unlawful or defamatory Content;
8.1.3 Not to impersonate other people;
8.1.4 Not to use the System for unauthorised mass-communication (spam).
8.2 We reserve the right to monitor and, if necessary, remove communications made via Our System.

10.2 If We terminate your Account, any pending orders may be cancelled.
11.1 We endeavour to ensure that all descriptions of Services on the Website are accurate.
11.2 All pricing information on the Website is correct at the time of posting. We reserve the right to change prices and alter Services where necessary.
11.3 Prices are in New Zealand dollars (NZD) and include GST unless otherwise stated.
11.4 We cannot guarantee availability of in-person courses until minimum enrolment numbers are met.
12.1 Your order constitutes a contractual offer. Acceptance occurs when We send a confirmation email.
12.2 Payment is required before access to Services is granted.
12.3 Online courses: enrolment is confirmed once payment is processed and you receive login details.
12.4 In-person courses: enrolment is confirmed once payment (or deposit, if applicable) is received. We reserve the right to reschedule or cancel in-person courses due to trainer illness, venue availability, or minimum enrolments not being met. In such cases, you may choose a full refund or transfer to another course date.
12.5 We will provide Services with reasonable care and skill, in line with the Consumer Guarantees Act 1993.
13.1 Student cancellations – In-Person Courses:
13.1.1 Cancellations with 14 or more days’ notice – full refund (less admin fee if applicable).
13.1.2 Cancellations with 7–13 days’ notice – 50% refund.
13.1.3 Cancellations with less than 7 days’ notice – no refund, but transfer to another course date may be offered at our discretion.
13.2 Student cancellations – Online Courses: No refunds once a course has been accessed in full, unless required by the Consumer Guarantees Act 1993.
13.3 Provider cancellations: If NZ Drones Academy cancels or reschedules a course, you may choose a full refund or transfer to another course date.
14.1 Use of the Website is also governed by Our Privacy Policy, which is incorporated into these Terms by reference.
15.1 We make no warranty that the Website will meet your requirements, be error-free, or secure.
15.2 Nothing on this Website constitutes professional or legal advice.
16.1 The Website is provided “as is” and “as available”.
16.2 We accept no liability for unavailability due to factors beyond our control (e.g. internet outages, server failures).
17.1 To the maximum extent permitted by law, We accept no liability for indirect or consequential loss.
17.2 Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986.
17.3 Students attending in-person training must comply with all safety instructions. NZ Drones Academy is not liable for personal injury or property loss resulting from failure to follow such instructions, except where caused by our negligence.
Failure by either party to exercise any right shall not constitute a waiver of that right.
In the event of conflict between these Terms and any prior versions, these Terms prevail.
Nothing in these Terms confers rights on any third party.

22.1 These Terms and Conditions and the relationship between you and NZ Drones Academy shall be governed by and construed in accordance with the laws of New Zealand.
22.2 You and NZ Drones Academy agree to submit to the exclusive jurisdiction of the New Zealand courts.
